These Terms of Use (“Terms”) govern access to and use of the BSWAN AI  website, applications, platform, software, and related services (collectively, the “Service”) operated by BSWAN AI  (“Company”, “we”, “us”, or “our”).

By accessing or using the Service, you (“User”, “you”, or “Customer”) agree to be legally bound by these Terms. If you do not agree, you must not access or use the Service.

1. Description of the Service

BSWAN AI  provides an artificial intelligence–powered software platform designed to automate and assist with customer communications.

The Service includes, but is not limited to:

  • AI-driven voice agents for inbound and outbound calls

  • Lead qualification and data capture

  • Appointment scheduling and reminders

  • Call routing to human agents

  • Integration with third-party systems (e.g., CRM platforms)

  • Analytics and reporting tools

  • Bulk messaging capabilities (voice, SMS, email)

BSWAN AI  is a software-as-a-service (SaaS) provider and does not act as a telecommunications carrier, payment institution, bank, or financial intermediary.

1.1 Platform, Application, and Admin Dashboard

The Service includes a web platform and application where registered Users receive access to a personal administrative dashboard (“Admin Panel”).

Through the Admin Panel, Users may:

  • configure AI agents

  • upload and manage contact databases

  • launch outbound call campaigns

  • select target geographies

  • select outbound phone numbers

  • configure routing logic

  • send bulk voice, SMS, and email campaigns

  • integrate with third-party systems

  • access reports and analytics

  • manage billing and balances

BSWAN AI  provides the technology only. Users independently control how communications are conducted.

2. Eligibility

You represent and warrant that:

  • you are at least 18 years old;

  • you have legal capacity to enter into binding agreements;

  • if acting on behalf of an entity, you have authority to bind that entity.

3. Account Registration and Security

To access certain features, you must create an account.

You agree to:

  • provide accurate and complete information;

  • keep credentials confidential;

  • notify us immediately of unauthorized access.

You are fully responsible for all activity under your account.

3.1 Registration Process

During registration, Users may be required to:

  • provide name and contact details;

  • provide company information (if applicable);

  • verify email and/or phone number;

  • create login credentials;

  • accept these Terms and Privacy Policy.

We may request additional information, including:

  • business identification details

  • billing information

  • identity verification

  • intended use description

Access to certain features may be restricted until verification is completed.

3.2 Admin Dashboard Responsibility

After registration, Users receive access to an Admin Panel.

The User is fully responsible for:

  • all actions performed through the account;

  • all users granted access;

  • all uploaded data;

  • all communications sent via the platform.

If the account is created for a company, that company is the legal account holder.

3.3 Verification and Risk Review

To prevent fraud and abuse, BSWAN AI  may:

  • review newly created accounts;

  • request documentation;

  • limit functionality;

  • delay campaign activation.

This may apply especially to accounts that:

  • upload large databases

  • launch mass campaigns

  • target high-risk geographies

  • show rapid usage spikes

Failure to provide verification may result in suspension.

4. Acceptable Use

You agree not to use the Service for:

  • unlawful activity

  • fraud or deception

  • impersonation

  • intellectual property violations

  • malware distribution

We may suspend accounts for violations.

4.1 Anti-Spam and Anti-Abuse Policy

Strictly prohibited:

  • unsolicited robocalls without legal consent

  • spam email campaigns

  • mass messaging without lawful basis

  • purchased or scraped databases

  • phishing or scams

  • harassment campaigns

  • attempts to bypass telecom safeguards

Users must ensure lawful consent where required by GDPR, ePrivacy Directive, CAN-SPAM, and similar laws.

4.2 Responsibility for Uploaded Data

You represent that:

  • all uploaded contacts were collected lawfully;

  • you have legal basis to contact recipients;

  • consent exists where required;

  • you comply with all local communication laws.


BSWAN AI  does not verify uploaded databases.

5. Compliance With Laws

You are solely responsible for compliance with:

  • GDPR / CCPA / privacy laws

  • consumer protection laws

  • telecom and call-recording laws

  • consent and disclosure requirements

BSWAN AI  does not provide legal advice.

6. AI Limitations

You acknowledge:

  • AI outputs may be inaccurate or inappropriate;

  • AI does not replace human judgment;

  • we do not guarantee accuracy or reliability.


You are responsible for reviewing outputs.

7. Fees, Payments, and Account Balance

Some features require payment.

Unless stated otherwise:

  • all fees are non-refundable;

  • taxes are not included;

  • non-payment may result in suspension.

Accounts may include prepaid balances used for communication services.

In case of suspected abuse:

  • balances may be temporarily frozen during investigation;

  • funds may be held to cover telecom penalties, chargebacks, or fraud risks;

  • deductions may apply for damages caused by misuse.


All actions will be taken in compliance with applicable EU consumer protection laws.

8. Third-Party Services

The Service may integrate with:

  • telecom operators

  • cloud providers

  • CRM platforms


We are not responsible for their performance or compliance.

9. Intellectual Property

All rights to the platform, software, models, and content belong to BSWAN AI  or its licensors.

You receive a limited, non-exclusive license to use the Service.

10. Data Processing and Privacy

BSWAN AI  may process personal data in accordance with applicable laws.

Details are described in the Privacy Policy.

A separate Data Processing Agreement (DPA) may apply.

11. Confidentiality

Both parties agree to keep non-public information confidential unless disclosure is required by law.

12. Service Availability

The Service is provided “as is” and “as available.”

We do not guarantee:

  • uninterrupted access

  • error-free operation

  • full security


Maintenance may occur without notice.

13. Limitation of Liability

To the maximum extent permitted by law, BSWAN AI  is not liable for:

  • indirect or consequential damages;

  • loss of profits or data;

  • misuse of the Service;

  • reliance on AI outputs.


Total liability shall not exceed the amount paid in the previous 12 months.

14. Indemnification

You agree to indemnify BSWAN AI  from claims arising from:

  • your use of the Service;

  • violation of these Terms;

  • violation of laws or third-party rights.


15. Termination

We may suspend or terminate access:

  • for Terms violations;

  • for legal reasons;

  • to prevent abuse;

  • at our discretion.


Upon termination:

  • access is revoked;

  • campaigns stop immediately;

  • balances may be temporarily restricted pending review;

  • data may be deleted per retention policies.

16. Amendments

We may update these Terms from time to time. Continued use means acceptance.

17. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Republic of Cyprus.
Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of the Republic of Cyprus.
